Arizona State University Police Command Insulated from Accountability Once Again: Is it because of ASU’s deep pockets for Legal Defense OR were Plaintiff Lawyers Completely Incompetent?

When we initially read the complaint posted online we felt it was somewhat vague, but we are not lawyers. We would very much like to see an amended lawsuit with publicly exposed details we are able to take action on!

If this lawsuit is dead, we implore the plaintiffs to release all of their evidence for public domain! If it is ongoing, then we understand any reluctance to do so.

Again, we would like to reiterate the importance of:

FULL DISCLOSURE AND TRANSPARENCY NECESSARY TO BRING ABOUT POSITIVE CHANGE TO THE INCOMPETENT AND CORRUPT MANAGEMENT OF THE ARIZONA STATE UNIVERSITY POLICE DEPARTMENT.  THE SAFETY OF THE PUBLIC DEPEND ON ROOTING OUT THIS CORRUPTION AND MAKING AN EFFECTIVE POLICE DEPARTMENT OUT OF THE SINKING SHIP OF ASUPD. 

“The only thing that can be derived from the present complaint is that Plaintiffs believe they were treated poorly during their time working for the police department,” wrote Senior U.S. District Judge Roslyn O. Silver in her ruling, which was issued July 21.

The various complaints alleged by the employees lack specific facts, she wrote, “and it is not possible to determine which Defendant allegedly harmed which Plaintiff and in what way. ”

The employees alleged they were retaliated and discriminated against after they spoke out about problems within the university’s police department.

The civil suit was filed earlier this year in Maricopa County Superior Court and later transferred to federal court. The suit claimed university employees violated the police employees’ freedom of speech, forced some of them into retirement and created false internal investigations to punish people.

The suit also alleges employees were directed to change crime statistics “to make ASU appear safer” and that supervisors directed employees to change crime classifications to avoid the community “seeing the crime that occurred on or around campus.”

The suit sought punitive damages and attorney fees.

Attorneys for ASU asked the judge to dismiss the suit.

William O’Hayer, one of the plaintiffs in the suit and a former ASU police officer, said the employees intend to file an amended complaint before Aug. 4.

Silver wrote in her ruling issued this week that if the defendants wish to amend and proceed with their claims “they must do substantially better than they have done so far.”

ASU declined comment on the judge’s ruling.

Police officer’s lives are more at risk than ever. Brotherhood, honor, teamwork, and professionalism mean more than ever, and yet again the supervisor ranks at the Arizona State University Police Department set the bar even lower for their own would be brothers in blue as they betray the oath they took to become police officers.

The bar of integrity and professionalism has been historically low for command, hit and miss among the mid-level supervisors, but the attacks on employees were primarily confined to the topsy turvey workplace of the ASU Police Department where morality, law, policy only applies to line level employees.

We received information that these attacks have now gone against an officer in their private life and were inspired to issue this post. These new attacks outside the workplace are against an officer who had gone through one of the most traumatic events people go through. Instead of support this officer was betrayed by not one, but two middle supervisors while the command of ASUPD stood by encouraging and supporting the hostile behavior.

Imagine yourself as a Police Sergeant in charge of police officers charged with serving and protecting a community. Would you think it is appropriate to do the following things to an Officer under your command?

DISHONORED ASU POLICE SERGEANT: Nate Deveney

  • Approach a subordinate officer’s fiancée’, brag about sleeping with her, and then discipline this officer you betrayed.
  • Make up frivolous negative paperwork about this officer with the intent to insulate yourself from your own indiscretion, dishonor, and shame as their supervisor.
  • It’s not enough that you have leveraged your position with ASUPD for sexual conquests with students and other university employees, but you also have go after the women of the officers under your command?
  • You have dishonored yourself and the profession and should be ashamed of yourself.

DISHONORED ASU POLICE SERGEANT: Mike Roper

  • Receive phone calls from an officer’s ex-wife’s boyfriend, verbally slander and denigrate an officer under your command to this stranger, and then like the other supervisor make up frivolous negative paperwork about this officer with the intent to insulate yourself from your own indiscretion, dishonor, and shame as their supervisor.
  • Order an Officer under your command to complete a task, when that task meets the disapproval of your command claim the officer who followed your order was not following your orders. You have a pattern of doing this, so all the officers in conflict with you throughout your time as a supervisor must be liars. You are the LIAR.
  • YOU HAVE THREATENED ANOTHER ASU POLICE EMPLOYEE, PLUS OTHER ASU EMPLOYEES, WITH THE LETHAL FORCE OF A FIREARM BECAUSE OF YOUR TEMPER.
  • YOU WERE PROTECTED BY CHIEF JOHN PICKENS, AND YET YOU HAVE THE NERVE TO DOCUMENT NONSENSE IN SUBORDINATE FILES TO DISCREDIT THEM AND PLEASE COMMAND.
  • You have dishonored yourself and the profession and should be ashamed of yourself.

This is what Arizona State University Police Sergeants Nate Deveney and Michael Roper did to ASU Police Officers under their command. One had just gone through a messy divorce and custody battle with two children.

During the most difficult time in his life, losing his wife, losing his family, losing his home, the Supervisors at his police department prey on him, attack his new relationship, attack his career, financial stability, and force this officer to contemplate quiting for the sake of his own sanity. Absolutely disgusting!

This is what Officers and civilians at the Arizona State University Police Department expose themselves to in that toxic workplace environment.

They are seen as the enemy, not members of the team. This is the type of godless supervision waiting to prey on your career, your family, your entire life, your soul. Shame on them for what they did to officers under their command! Shame!

Not only do you have to watch your back in an increasingly dangerous world,

you have to watch your back within your own police department at ASUPD.

As sad as this is we are not surprised. We know a thing or two about this profession, about the issues of command, and the conduct of subordinates, junior supervisors, and it comes from the type of leadership they follow.

When former ASUPD Chief John Pickens picked his command he was sure to insulate himself with supervisors as morally bankrupt as himself in order to continue to operate the police department along his lines.

He hired former Tempe Police Assistant Chief Jay Spradling fresh off a mountain of scandal that forced him to retire or be fired from the City of Tempe Police Department.

Pickens hired current ASU Police Chief Mike Thompson who retired in shame from the City of Mesa Police Department after destroying his partner by coveting his partner’s wife at the police department and orchestrating his demise in the workplace to insulate himself from his own indiscretion, dishonor, and shame as a supervisor.

Sounds like a familiar theme after a while and it’s bsolutely disgusting.

They don’t happen unless criminals feel no threat in doing so, especially at colleges unless it’s the Arizona State University Crime Spree Zone.

With no staffing, no patrol presence, and completely incompetant management at the ASU Police department it’s going to get worse as word of mouth spreads about the ease of breaking the law and getting away with it more often than not.

ASU police investigate armed robbery at student housing on Mesa Polytechnic campus

Arizona State University police are investigating an armed robbery that was reported late Sunday night on the Polytechnic campus in Mesa.

Police say a man, armed with a handgun, forced his way into a residence shortly before midnight at West Desert Village, a student-housing complex on the Mesa campus, and demanded the victim’s laptops and cellphones. The man then fled out the back door.
The suspect is described by police as a white man from 16 to 30 years old. He is about 5 feet, 8 inches tall with a thin build and short blond hair. Police say he wore dark jeans and a green hooded shirt with writing. He had a black bandana over the lower part of his face.
ASU Police say no arrests have been made. Anyone with information is asked to call ASU Police.
The department put out two emergency alerts early Monday morning, the first asking people to avoid the area near 6928 E. Usher Ave., and the second giving the all clear.

Robberies have not been common occurrences on ASU campuses in recent years, according to statistics the university is required to report to the federal government under the Clery Act.
In 2014, the Tempe campus reported three robberies, the West and Downtown Phoenix campuses each reported two robberies and the Polytechnic campus reported one robbery. Clery statistics for 2015 won’t be published until October, and 2016 statistics won’t be available until the following year.
Crimes that occur off campus near universities aren’t generally required to be reported under the Clery Act unless the crime occurs on property the university rents or controls.

ASU Police Command puts entire community at risk

Taken no action or taken improper action, that’s what this criticism has been about all along. It’s about situations where command has taken no action when they had a duty to act AND situations where command took negative improper action contrary to the best interests of the ASU community they are sworn to serve.

This is just one more example of “misconduct in office”. It’s one more example of how the members of the Arizona State University Police Department Command are more interested in covering their own asses than doing what needs to be done in the best interests of the community they are sworn to serve and protect. Absolutely disgraceful.

The charge of “misconduct in office” is broad, and encompasses conduct that includes malfeasance, where someone knowing commits a crime, misfeasance, where someone “does a lawful act in a wrongful manner” and nonfeasance, where someone fails to act when required by their job.

This is a nonfeasance in office issue that puts everyone at the ASU community at risk. How long as this been happening? Why was nothing done? The one thing we are certain of is that this commander will have plenty of excuses for his inaction that will be less than truthful.

The Integrity Report on the ASU Police Department exposes an opposition Bigot against the GLBT Community within the ASU police department.

You know we will delete what exactly? We relish every opportunity to expose you for what you are. In this case nothing more than a scared and defeated bigot lashing out. Your anger, ignorance, and desperation are words to your sad little swan song. I pity the people who see you in uniform expecting honor, equality, fairness, integrity, and receiving what we see here instead.

Ladies and gentlemen, it looks like “the clique” within the Arizona State University Police Department is cracking under the pressure and we have potentially exposed a bigot within our opposition. We’re not surprised. The opposition makes one self-defeating decision after another and it is embarrassing  to have enemies so juvenile and feeble minded. 

We are against any form of discrimination because we are proud Americans who support freedom and equality no matter what race, creed, gender, religion or sexual orientation you may be. We would like to once again remind the bigoted people in our opposition about the oath they took to be sworn police officers. The fact they forgot it, ignored it, and broke the oath are why we are here today.

: a person who strongly and unfairly dislikes other people, ideas, etc. : a bigoted person; especially : a person who hates or refuses to accept the members of a particular group (such as a racial or religious group)

Is it acceptable to have a bigot working at a police department? Of course not. This opposition poster uses a police code as their name and uses and Arizona State University email address to post it. I would like to know which member of the Arizona State University Police Department created this Email address and uses derogatory language aimed at the GLBT community and yet claims to support the sworn Officer code of ethics, diversity, and promises do exactly the opposite of what they’re doing. Does this person support the university mission? If this person was handling their police call would a GLBT member of the ASU community receive the same treatment under the law as a straight person.

Required Reporting

Unless a person is restricted by law from doing so, any employee who is informed of or has a reasonable basis to believe that sexual harassment has occurred, shall immediately report all information regarding the occurrence(s) to the Office of Equity and Inclusion/Title IX Coordinator.

Failure to report and/or inaction may be cause for disciplinary action.

If an individual wishes to have a confidential conversation about an allegation of sexual harassment, that individual can do so by seeking an appointment with a licensed counselor or health care professional. The university provides such services at the Health Services, Employee Assistance Office, or ASU Counseling Services located on each campus. Also, consistent with state law, the ASU Police Department Victim’s Advocate is a person with whom an individual can hold a confidential conversation about an allegation of sexual violence, including sexual assault.

Additionally, any individual has the right to contact local law enforcement to file a criminal report.

A supervisor, manager, or administrator who is informed of or has a reasonable basis to believe that violations of this policy, other than sexual harassment, have occurred shall promptly report it to the Office of Equity and Inclusion. Failure to report or supervisory inaction may be cause for disciplinary action.

Anyone who believes that he or she has been subjected to discrimination, harassment, or retaliation in violation of this policy, or who believes that this policy has been violated, should report the matter immediately to the Office of Equity and Inclusion. (But keep in mind they won’t do anything about it, see below)

Anonymity

If an individual wishes to remain anonymous, that individual can make a report to the ASU Hotline at 877/786–3385. (But keep in mind they won’t do anything about it.)

If an individual requests anonymity after a report is filed, the Office of Equity and Inclusion/Title IX Coordinator will take into account the request, the due process rights of all parties involved, the severity of the alleged harassment, and the potential risk of a hostile environment for others in the community in order to determine whether the request can be honored. The requesting party will be advised of the determination. (But keep in mind they won’t do anything about it, see below)

Despite our knowledge of the corrupt inner workings of ASU Police Dept, we were somewhat surprised about the depravity tolerated, protected, and by default sanctioned by the Arizona State University administration.

TEMPE, Ariz. – For the first time, former Arizona State University police officers have publicly spoken out against their former department, accusing it and the university, of misreporting crime statistics in violation of the Clery Act.

The Clery Act is a federal law that requires colleges and universities to report and publish crime statistics involving their students.

Former ASU police detective Matt Parker said he examined the statistics himself and compared them to the published Clery Act report.

Parker said crimes that are reported to ASU’s administration, but not investigated as crimes, are supposed to be included in the school’s Clery Act data. But he said those reports did not always make it to the police department.

Former Officer William O’Hayer said he was even encouraged to downplay some crimes.

“Maybe lower a felony to a misdemeanor, or something of that nature, yeah,” O’Hayer said. “It’s pretty blatant.”

“That’s the culture there,” former police aide Ben Flynn said. “Just sweep it under the rug — ignore it; it’ll go away.”

“It’s the norm, where they decide what they want to report, what they don’t want to report,” former Sgt. Patrick Murphy said.

Murphy said he was Parker, O’Hayer and Flynn’s supervisor at ASU PD.

All four officers have since left the ASU police force on their own.

They, along with four other officers, are suing the ASU Police Department.

ASU declined to answer questions on camera, but sent a statement that read: “We do not comment on pending litigation, regardless of how unsubstantiated, malicious or meritless it may be.”

The university has filed a motion to dismiss the lawsuit.
